By accessing or using Creator Lookup, you agree to be bound by these Terms. If you do not agree, do not use our services.

Definitions
"Platform" means the Creator Lookup web application, mobile apps, APIs, and all related technology at creatorlookup.com.
"Services" means professional services we provide, including influencer outreach, campaign management, consulting, and market research.
"You," "Your," "Client" means the individual or entity using Creator Lookup.
"Creator" means social media influencers, content creators, or public figures whose data appears in our database.
"Content" means text, images, data, code, and other materials available through the Platform.
"User Content" means content you upload, create, or submit through the Platform.
"Subscription" means paid access to Platform features on a recurring basis.
"Campaign" means influencer marketing initiatives managed through our Services.
"Deliverables" means work product provided as part of our Services (reports, lists, campaign results).
Eligibility and Account Registration
2.1 Eligibility
To use Creator Lookup, you must:
Be at least 18 years of age
Have the legal capacity to enter into a binding contract
Not be prohibited from using our services under applicable law
Represent a legitimate business or operate as a bona fide individual
Business Accounts: If registering on behalf of a company, you represent that you have authority to bind that entity to these Terms.
2.2 Account Registration
Required Information:
Accurate and current name, email, and company information
Valid payment method for paid services
Compliance with our verification requirements
Your Responsibilities:
Maintain the confidentiality of your password and account credentials
Notify us immediately of any unauthorized access (email: security@creatorlookup.com)
Accept responsibility for all activity under your account
Keep your account information up to date
Account Security:
Do not share your login credentials with anyone
Use a strong, unique password
Enable additional security measures when available
We are not liable for losses caused by unauthorized use of your account if you fail to maintain the security of your credentials, except where we fail to implement reasonable security measures.
2.3 Account Suspension or Termination
We may suspend or terminate your account if:
You violate these Terms
Your payment fails or you have outstanding balances
We detect fraudulent activity
You misuse creator data or engage in spam
Required by law or to protect our rights

Creator Lookup operates as both a SaaS platform and a professional services provider. Your use is governed by the applicable sections below.

PART A: PLATFORM/SaaS TERMS
Platform/SaaS Terms
4.1 License Grant
Limited License:
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Access and use the Platform for your internal business purposes
Access creator data available through your subscription tier
Use our tools and features as intended
Restrictions:
You may NOT:
Sublicense, resell, or redistribute Platform access
Copy, modify, or create derivative works of our software
Reverse engineer, decompile, or disassemble the Platform
Use automated tools to scrape or mass-download data beyond your subscription limits
Remove or modify any proprietary notices or labels
Use the Platform to build a competing service
Share your account credentials with unauthorized users
4.2 Subscription Plans and Access
Subscription Tiers:
We offer various subscription plans with different features, data access limits, and pricing. Your access is determined by your active subscription level.
Free Trials:
We may offer free trials at our discretion. Trials convert to paid subscriptions unless canceled before the trial period ends. No refunds are provided for charges incurred after trial conversion.
Plan Changes:
Upgrades take effect immediately; you're charged the prorated difference
Downgrades take effect at the next billing cycle
Cancellations remain active until the end of the current billing period
Usage Limits:
Each subscription tier has limits on:
Number of creator profiles you can view/export per month
Search query volume
API calls (if applicable)
User seats
Exceeding limits may result in overage charges or temporary service suspension. We will notify you before applying overages.
4.3 Data Accuracy and Availability
Creator Data:
We make commercially reasonable efforts to provide accurate, up-to-date creator data. However:
Data is sourced from public social media profiles and third parties
We cannot guarantee 100% accuracy or completeness
Contact information may become outdated
Metrics are estimates and may not match platform analytics exactly
We update data periodically but cannot guarantee real-time accuracy
No Warranty on Data Quality:
Creator Lookup is provided "as is" with respect to data accuracy. We do not warrant that creator data will be error-free, complete, or suitable for your specific purposes.
If you identify inaccurate data, please report it to support@creatorlookup.com and we will investigate.
4.4 Platform Availability and SLA
Uptime Commitment:
We strive for 99.5% uptime (excluding scheduled maintenance). This is a target, not a guarantee.
Scheduled Maintenance:
We may perform scheduled maintenance with advance notice. We will minimize disruption and aim for off-peak hours.
Unplanned Downtime:
We are not liable for downtime caused by:
Third-party service failures (hosting, CDN, social media APIs)
DDoS attacks or security incidents
Force majeure events (see Section 14)
Issues caused by your violation of Terms
No Refunds for Downtime:
Subscription fees are not prorated or refunded for downtime unless it exceeds 10 consecutive days.
4.5 API Usage (If Applicable)
API Access:
Some plans include API access. API usage is subject to:
Rate limits specified in your plan
Our API documentation and guidelines
Prohibition on reselling API access
Caching requirements to minimize unnecessary calls
API Changes:
We may modify or deprecate API endpoints with 30 days' notice. We are not liable for issues caused by API changes if we provide reasonable notice.
4.6 Beta Features and New Features
Beta Access:
We may offer access to beta features or experimental tools. Beta features are:
Provided "as is" without warranty
Subject to change or removal without notice
Not covered by any SLA or support commitments
May have bugs or unexpected behavior
By using beta features, you acknowledge they are experimental and may not perform as expected.

PART B: PROFESSIONAL SERVICES TERMS
Professional Services Terms
5.1 Service Scope and Engagement
How Services Work:
When you engage our professional services, we act as your agent to execute influencer marketing campaigns, conduct research, or provide consulting.
Engagement Process:
Discovery Call: We discuss your goals, target audience, and budget
Proposal: We provide a detailed scope of work and pricing
Agreement: You approve the proposal and make payment
Execution: We deliver the agreed services
Review: We provide deliverables and incorporate feedback
Scope Changes:
Any changes to agreed scope must be approved in writing. Scope changes may result in additional fees and timeline adjustments.
5.2 Service-Specific Terms
5.2.1 Influencer Outreach Services
What's Included:
Creator identification based on your target criteria
Personalized outreach messaging
Negotiation support
Response management
What's NOT Included:
Guaranteed response rates or acceptance rates
Creator payments (unless using managed campaign service)
Content creation or creative direction
Long-term relationship management beyond the campaign
Performance Expectations:
Response rates vary by industry, creator size, offer quality, and market conditions. We do not guarantee specific response rates, open rates, or acceptance rates.
Typical Benchmarks (Not Guarantees):
Cold email open rates: 30-60%
Response rates: 5-20%
Acceptance rates: 2-10%
These are estimates and actual results may vary significantly.
5.2.2 Guaranteed Response Campaigns
If your campaign includes a guaranteed minimum number of qualified creator responses:
Definition of "Qualified Creator":
A creator who:
Meets ALL targeting criteria specified in your completed intake form (follower count, niche, location, etc.)
Responds affirmatively to your campaign proposal
Provides pricing at or below your stated budget (excluding usage rights/additional fees if not specified)
Example:
If you specify "fitness creators with 10K-100K followers, $500 per TikTok post," a qualified response is from a fitness creator in that follower range who agrees to $500 or less.
Important Rules:
Targeting criteria are locked once the intake form is finalized
You cannot change or add criteria after outreach begins
"Qualified" is based on publicly available data at time of outreach
Pricing must exclude usage rights unless specified upfront
If We Don't Meet the Guarantee:
We will continue outreach at no additional cost until the guaranteed number is reached, or provide a pro-rata refund for unmet responses.
5.2.3 Managed Campaign Services
What's Included:
End-to-end campaign management
Creator sourcing, outreach, and negotiations
Contract execution and creator payments
Content approval workflow
Performance tracking and reporting
How Payment Works:
Your payment funds an escrow account for creator deals
Funds are released to creators upon deliverable fulfillment
We charge a management fee (typically 15-25% of creator spend)
Campaign Timeline:
Setup: 3-7 days
Outreach: 1-4 weeks (depending on scale)
Content production: 2-8 weeks (creator-dependent)
Reporting: Within 7 days of campaign completion
Creator Payments:
We pay creators on your behalf from your funded escrow. Creator payments are non-refundable once:
You approve the creator for the campaign
The creator confirms acceptance
The contract is signed
Content Approval:
You have 48 hours to review and approve/request revisions for creator content. If you do not respond within 48 hours, content is considered approved and funds are released.
Breach of Contract by Creator:
If a creator fails to deliver agreed content, we will:
Attempt to resolve with the creator (72-hour window)
If unresolved, refund the creator's fee from escrow
Offer a replacement creator if possible
You must report creator non-performance within 72 hours of the agreed delivery date.
5.2.4 Consulting and Strategy Services
What's Included:
Market research and competitive analysis
Influencer strategy development
Campaign planning and recommendations
Data-driven insights and reporting
Deliverables:
Consulting deliverables are provided as:
Written reports or presentations
Strategic recommendations
Data analysis and benchmarking
Revisions:
We offer one round of reasonable revisions to consulting deliverables. Additional revisions may incur extra fees.
No Guarantee of Results:
Consulting recommendations are based on best practices and data analysis, but we cannot guarantee implementation success or specific business outcomes.
5.3 Client Responsibilities for Services
You agree to:
Provide timely information, feedback, and approvals
Clearly communicate campaign goals and constraints
Review and approve deliverables within specified timeframes
Pay invoices on time
Comply with FTC guidelines and platform rules for influencer marketing
Ensure you have rights to any brand assets you provide
Delays Caused by Client:
If your delays extend project timelines beyond 30 days, we may:
Charge additional project management fees
Terminate the engagement and retain payment for work completed
Adjust deliverables to match time constraints
5.4 Service Deliverable Timeline
Typical Timelines:
Creator lists: 3-7 business days
Outreach campaigns: 2-6 weeks (depending on scale)
Managed campaigns: 4-12 weeks (depending on complexity)
Consulting projects: 2-4 weeks (depending on scope)
Timelines are estimates, not guarantees. Actual delivery may vary based on scope, responsiveness, and external factors (creator availability, platform changes).
5.5 Communication and Project Management
Primary Contact:
You will be assigned a dedicated account manager for service engagements.
Communication Channels:

Slack (for managed campaigns, if requested)
Scheduled check-in calls
Response Times:
Client inquiries: 24 business hours
Urgent issues: 4 hours during business hours
Escalation:

Payments, Billing, and Refunds
6.1 Pricing and Fees
Subscription Fees:
Billed monthly or annually in advance. Pricing is available on our website and subject to change with 30 days' notice for existing customers.
Service Fees:
Professional services are quoted on a project basis. Pricing is provided in proposals and invoices.
Taxes:
All fees are exclusive of taxes. You are responsible for all applicable sales, use, VAT, or other taxes (except taxes on our income).
6.2 Payment Terms
Upfront Payment Required:
Unless otherwise agreed in writing, all services require full payment upfront via:
Credit card (Stripe)
ACH transfer
Wire transfer (for invoices >$10K)
Exceptions to Upfront Payment:
In rare cases, we may offer payment terms (e.g., Net 15, Net 30). If granted:
Remaining balance must be paid within 72 hours of service delivery
Late payments accrue 1.5% monthly interest (18% APR) or maximum allowed by law
We may pause service or notify creators involved in campaigns if payment is overdue
Failed Payments:
If your payment fails:
We will attempt to re-charge your card up to 3 times
Your account will be suspended after 3 failed attempts
We may terminate your account after 30 days of non-payment
You remain liable for all fees incurred
6.3 Refund Policy
Philosophy:
We strive for customer satisfaction but must balance that with the real costs of data acquisition, service delivery, and creator relationships.
Refund Eligibility by Service Type:
6.3.1 Data Services (Creator Lists, Contact Data)
No Refunds, With Exceptions:
All payments for data services are final. However:
Partial Refund (Up to 50%):
If a material portion of delivered data is:
Corrupted or inaccessible
Fails to meet clearly defined, agreed-upon criteria (e.g., wrong platform, missing critical fields)
Duplicative (>25% duplicates)
How to Request:
Email refunds@creatorlookup.com within 7 days of delivery
Provide specific examples of data issues
We will investigate and issue a pro-rata refund for unusable data
No Refunds For:
Subjective quality complaints ("I don't like these creators")
Change of mind or business direction
Data being publicly available elsewhere
Inaccurate contact info (we make best efforts but cannot guarantee 100% accuracy)
6.3.2 Outreach Services (Cold Email, DMs)
No Refunds After Outreach Begins:
Once we've started outreach, refunds are not available under any circumstances.
Why:
We've incurred costs (email infrastructure, labor, list preparation)
Market variability means results fluctuate (we cannot control creator behavior)
We've invested time in personalization and strategy
What We CAN Do:
Provide additional outreach rounds (if performance is significantly below benchmarks)
Adjust messaging and retry (if open rates are unusually low)
Extend campaigns to hit guaranteed response thresholds (if applicable)
Refund Before Outreach Starts:
If you cancel before we send the first outreach message, we will refund 50% (to cover setup and research costs).
6.3.3 Managed Campaign Services
Escrow-Based Model:
Your payment funds creator deals. Refund eligibility depends on fund status:
Unused Funds:
You may withdraw unused funds at any time, subject to a 20% early withdrawal fee (covers setup, sourcing, and overhead).
Committed Funds:
Once you approve a creator and we issue a contract, those funds are non-refundable (they're earmarked for the creator).
Disputed Deliverables:
If a creator fails to deliver, we will:
Withhold payment to the creator
Refund you OR offer a replacement creator
You must report issues within 72 hours of content delivery
After 72 Hours:
If you don't report issues, we consider the deliverable accepted and release funds to the creator.
6.3.4 Consulting Services (Strategy, Research, Competitive Analysis)
No Refunds After Delivery:
Consulting work is non-refundable once delivered. We invest significant intellectual labor in research and analysis.
What We Offer Instead:
One round of revisions included
Follow-up consultation to clarify recommendations
Adjustments based on feedback
Refund Before Delivery:
If you cancel before we deliver the final report, we will refund based on work completed:
0-25% complete: 75% refund
25-50% complete: 50% refund
50-75% complete: 25% refund
75%+ complete: No refund
6.3.5 Subscription Refunds
No Pro-Rata Refunds:
Subscription fees are non-refundable. If you cancel, you retain access until the end of your billing period.
Exception:
If we make material changes to features that significantly reduce your plan's value, you may request a pro-rata refund for the unused portion.
6.4 General Refund Terms
No Refunds For:
Client-caused delays or indecision
Scope changes or shifting priorities
Partial use of services ("I only used it for one week")
Dissatisfaction unrelated to service quality (subjective preferences)
Market conditions or creator behavior beyond our control
Refund Process:
Email refunds@creatorlookup.com with your request and justification
We will investigate within 5 business days
If approved, refunds are issued within 10 business days to the original payment method
Refund decisions are final
Chargeback Policy:
If you initiate a chargeback without contacting us first:
Your account will be immediately terminated
You waive rights to any deliverables or data
We may pursue legal action to recover costs
You will be responsible for chargeback fees ($25+)
Always contact us before initiating a chargeback. We're reasonable and will work with you.
Intellectual Property Rights
7.1 Our IP
Platform Ownership:
Creator Lookup, including the Platform, software, algorithms, UI/UX, branding, and creator database structure, is owned by Creator Lookup and protected by copyright, trademark, and trade secret laws.
You do NOT acquire any ownership rights by using our Platform or Services.
Restrictions:
Do not copy, modify, or reverse engineer our Platform
Do not use our branding without written permission
Do not create derivative works based on our software or data structure
7.2 Creator Data Rights
Limited License to Creator Data:
When you access creator data through our Platform:
You have a limited license to use it for your influencer marketing purposes
You may not resell, redistribute, or republish creator data
You may not build a database or competing platform using our data
You must comply with anti-spam laws (CAN-SPAM, GDPR, CASL)
Creators Own Their Data:
Contact information and public profile data belongs to creators. We simply aggregate publicly available information. If a creator requests removal, we will comply (see Privacy Policy).
7.3 Your Content and User Content
User Content:
You retain ownership of content you upload or create using the Platform (campaign briefs, notes, custom lists, messages).
License to Us:
By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:
Store and display your content as necessary to provide services
Use anonymized, aggregated insights for platform improvement
Share campaign briefs with creators (when you use outreach services)
You Represent and Warrant:
You own or have rights to all User Content you upload
Your content does not infringe third-party IP rights
Your content complies with applicable laws (FTC disclosure rules, etc.)
7.4 Service Deliverables
Who Owns What:
Consulting Reports and Strategy Documents:
You own the deliverables we create specifically for you. However:
We retain the right to use general methodologies, frameworks, and insights
We may create similar work for other clients
We own any underlying tools or templates used to create deliverables
Creator Lists and Data:
You have a license to use the data, but we retain ownership of the database and methodology.
Campaign Content:
Creators own the content they create for your campaigns. You acquire usage rights based on your contract with the creator.
7.5 Feedback and Suggestions
Feedback License:
If you provide feedback, ideas, or suggestions about our Platform or Services, you grant us a perpetual, irrevocable, royalty-free right to use, modify, and incorporate that feedback without compensation or attribution.
Data Rights and Ownership
8.1 Your Data
You Own Your Data:
Any data you input into the Platform (account info, campaign data, notes) remains your property.
Our Rights:
We may use your data to:
Provide services to you
Generate anonymized, aggregated analytics and benchmarks
Improve our Platform and algorithms
We will NOT:
Sell your personal data to third parties
Share your campaign strategies with competitors
Use your data in ways that violate our Privacy Policy
8.2 Creator Data
Ownership:
Creator data is publicly sourced, and creators own their own information. We own the compiled database, structure, and enrichments.
Your License:
When you access creator data, you receive a limited license to:
Use it for influencer marketing within your business
Contact creators for campaign opportunities
Analyze data for strategy purposes
You May NOT:
Resell or redistribute creator data
Build a competing platform or database
Spam creators or violate anti-spam laws
Use data for purposes unrelated to influencer marketing
8.3 Data Portability
Exporting Your Data:
You can export:
Creator lists you've saved
Campaign performance data
Your account information
Formats: CSV, JSON, or other standard formats (depending on data type).
Limitations:
You cannot export the entire creator database or access data beyond your subscription tier.
8.4 Data Upon Termination
When your account is terminated:
You have 30 days to export your data
After 30 days, we may delete your data (except as required by law)
Campaign data may be retained for analytics (anonymized)
Creator data remains in our database (it's not exclusively yours)
Prohibited Uses and Acceptable Use Policy
9.1 Prohibited Activities
You agree NOT to:
Platform Abuse:
Scrape or use bots to extract data beyond your subscription limits
Attempt to access restricted areas of the Platform
Reverse engineer or decompile our software
Circumvent rate limits or access controls
Share your account with unauthorized users
Data Misuse:
Resell or redistribute creator data
Build a competing database or platform
Use data for illegal purposes (harassment, fraud, doxxing)
Violate anti-spam laws (CAN-SPAM, GDPR, CASL)
Harmful Conduct:
Send spam or unsolicited bulk messages to creators
Harass, threaten, or abuse creators or our staff
Impersonate others or misrepresent your identity
Engage in fraudulent or deceptive practices
Security Violations:
Attempt unauthorized access to our systems
Introduce viruses, malware, or malicious code
Conduct penetration testing without permission
Interfere with Platform performance or availability
Legal Violations:
Use the Platform for illegal purposes
Violate FTC influencer marketing disclosure rules
Infringe third-party intellectual property
Violate export control or sanctions laws
9.2 FTC Compliance for Influencer Marketing
Your Responsibility:
If you engage creators through our Platform or Services, you must:
Ensure creators disclose paid partnerships (FTC requires #ad, #sponsored, etc.)
Provide clear guidelines on disclosure requirements
Monitor creator content for compliance
Not incentivize creators to hide the commercial nature of content
We are not responsible for your compliance with FTC rules, but we may terminate accounts that engage in deceptive practices.
9.3 Creator Relationship Standards
When contacting creators:
Be professional and respectful
Clearly identify yourself and your brand
Provide accurate campaign details
Honor agreements and pay creators on time
Do not harass creators who decline or don't respond
We reserve the right to suspend accounts that damage the creator community or our reputation.
9.4 Enforcement
If you violate these Terms:
We may issue a warning
We may suspend your account temporarily
We may terminate your account permanently
We may retain payment for services already rendered
We may report illegal activity to authorities
We reserve the right to cooperate with law enforcement and provide user data when required.
Warranties and Disclaimers
10.1 Limited Warranty
We warrant that:
We will provide services with reasonable care and skill
Our Platform will operate substantially as described
We have the right to provide the services
This warranty is limited to a period of 30 days from service delivery or subscription start.
10.2 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATOR LOOKUP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE DISCLAIM ALL WARRANTIES, INCLUDING:

Merchantability
Fitness for a particular purpose
Non-infringement

Specific Disclaimers:
We do not warrant that the Platform will be error-free or uninterrupted
We do not guarantee data accuracy, completeness, or timeliness
We do not guarantee specific results from influencer campaigns (engagement, sales, ROI)
We do not warrant that creators will respond, accept deals, or deliver quality content
We do not guarantee compatibility with all devices or browsers
Third-Party Services:
We rely on third-party providers (hosting, social media APIs, email services). We are not responsible for their failures or changes.
Market Variability:
Influencer marketing outcomes depend on many factors beyond our control (creator behavior, audience engagement, market trends, platform algorithm changes).
Some jurisdictions do not allow disclaimer of implied warranties, so some of these disclaimers may not apply to you.
Limitation of Liability and Indemnification
11.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Cap on Damages:
Our total liability for any claim arising from your use of Creator Lookup shall not exceed the greater of:
(a) The amount you paid us in the 12 months preceding the claim, OR
(b) $500 USD
Excluded Damages:
We are NOT liable for:
Indirect, incidental, consequential, or punitive damages
Lost profits, revenue, or business opportunities
Loss of data or goodwill
Cost of substitute services
Damages from influencer campaigns that don't perform as expected
Damages from creator misconduct or non-performance
Damages from data inaccuracies or breaches by third parties
Even if we've been advised of the possibility of such damages.
Exceptions:
This limitation does not apply to:
Our gross negligence or willful misconduct
Liability that cannot be excluded by law (e.g., personal injury)
Our indemnification obligations (see below)
Basis of the Bargain:
These limitations reflect the allocation of risk and are a fundamental basis of our agreement. Without these limitations, we could not provide services at current pricing.
Some jurisdictions do not allow limitation of liability for certain damages, so some limitations may not apply to you.
11.2 Indemnification by You
You agree to indemnify, defend, and hold harmless Creator Lookup, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
Your violation of these Terms
Your violation of any law or regulation
Your violation of third-party rights (IP, privacy, publicity)
Your misuse of creator data or spam activity
Content you upload or transmit through the Platform
Your relationships and contracts with creators
Your influencer marketing campaigns (FTC compliance, false advertising, etc.)
We reserve the right to assume exclusive defense of any claim, at your expense.
11.3 Indemnification by Us
We agree to indemnify you from third-party claims that our Platform infringes their intellectual property rights, provided:
You notify us promptly of the claim
You give us control of the defense and settlement
You cooperate with our defense efforts
Our Remedies:
If we face an infringement claim, we may:
Obtain a license for you to continue using the Platform
Modify the Platform to avoid infringement
Replace the infringing component
If none of the above are feasible, terminate your access and refund pro-rata subscription fees
This indemnity does NOT apply if infringement results from:
Your modification of the Platform
Your combination of the Platform with other services
Your violation of these Terms
Term and Termination
12.1 Term
Subscriptions:
Your subscription continues on a recurring basis (monthly or annually) until canceled.
Services:
Professional services engagements have a defined term specified in the proposal or statement of work.
12.2 Termination by You
Subscription Cancellation:
You may cancel anytime through account settings or by emailing support@creatorlookup.com
Cancellation takes effect at the end of your current billing period
No refunds for the current billing cycle
Service Termination:
You may terminate a service engagement per the terms in your proposal
Early termination may result in fees for work already completed
12.3 Termination by Us
We may terminate your account immediately if:
You violate these Terms
You fail to pay fees when due
You engage in fraudulent or illegal activity
You abuse creators or damage our reputation
Required by law or to protect our rights
We may terminate your account with 30 days' notice for:
Business reasons (discontinuing service)
Repeated minor violations
Inactivity (no login for 12+ months)
12.4 Effect of Termination
Upon termination:
Access:
Your access to the Platform is immediately revoked.
Data:
You have 30 days to export your data. After 30 days, we may delete it (except as required by law).
Payments:
Outstanding fees become immediately due
No refunds for prepaid services (unless required by law)
Unused escrow funds (for managed campaigns) may be refunded, minus withdrawal fee
Survival:
These sections survive termination: Payments, IP Rights, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, General Provisions.
Creator Relationships:
If you have active campaigns with creators, we may notify creators of termination to prevent confusion or disruption.
Dispute Resolution and Arbitration
13.1 Informal Resolution
Before filing a claim, you agree to contact us at legal@creatorlookup.com and attempt to resolve the dispute informally for at least 30 days.
13.2 Binding Arbitration
If informal resolution fails, you agree that disputes will be resolved through binding arbitration, not in court.
Arbitration Rules:
Administered by JAMS or AAA
Governed by the Federal Arbitration Act (FAA)
One neutral arbitrator
Location: Miami, Florida (or remote)
Each party pays their own costs (unless law requires otherwise)
What Can Be Arbitrated:
All disputes related to these Terms, the Platform, or our Services, including:
Breach of contract
Fraud or misrepresentation
IP infringement (except where we need injunctive relief)
What Cannot Be Arbitrated:
Small claims court matters (under $10,000)
Injunctive relief to prevent IP infringement or Terms violations
No Class Actions:
You agree to arbitrate only on an individual basis. No class arbitrations, class actions, or representative actions are permitted.
Opt-Out:
You may opt out of arbitration by emailing legal@creatorlookup.com within 30 days of account creation.
13.3 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
If arbitration does not apply, exclusive jurisdiction is in the state and federal courts of San Francisco County, California.
Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including:
Natural disasters (earthquakes, floods, fires)
War, terrorism, or civil unrest
Government actions or regulations
Pandemics or public health emergencies
Internet or telecommunications failures
Third-party service outages (AWS, social media APIs, etc.)
Cyber attacks or security incidents
If a force majeure event lasts more than 30 days, either party may terminate the affected services.

You agree to comply with all applicable laws, including:

CASL (Canada)
FTC Rules:
Influencer marketing disclosure requirements
Truth in advertising
Endorsement guidelines
Platform Policies:
Instagram, TikTok, YouTube terms of service
Platform-specific rules for influencer partnerships
Export Controls:
You may not use our Platform in embargoed countries
You may not provide access to sanctioned entities
15.2 Our Compliance
We comply with:
GDPR, CCPA, and other privacy laws
PCI DSS for payment security (via Stripe)
SOC 2 Type II (in progress)
We reserve the right to refuse service to ensure compliance.
Modifications to Terms
16.1 Changes to Terms
We may modify these Terms at any time.
Notice:
We will post the updated Terms on our website
We will update the "Last Updated" date
For material changes, we will email you 30 days in advance
Acceptance:
Continued use after changes constitutes acceptance
If you don't agree, you must stop using the Platform and cancel your account
16.2 Changes to Services or Pricing
We may:
Add, modify, or discontinue features
Change pricing for new customers
Increase pricing for existing customers with 30 days' notice
You may cancel if you don't agree with changes.
General Provisions
17.1 Entire Agreement
These Terms, along with our Privacy Policy and any signed proposals, constitute the entire agreement between you and Creator Lookup.
Supersedes: All prior agreements, discussions, or representations.
17.2 Assignment
You may not assign these Terms without our written consent.

To an affiliate or subsidiary
In connection with a merger, acquisition, or sale of assets
17.3 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
17.4 Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
Waivers must be in writing to be effective.
17.5 No Third-Party Beneficiaries
These Terms are solely for your and our benefit. No third party (including creators) has rights under these Terms.

17.7 Relationship
You and Creator Lookup are independent contractors. These Terms do not create a partnership, joint venture, employment, or agency relationship.
17.8 Interpretation
Headings are for convenience only and do not affect interpretation.
"Including" means "including but not limited to."
"May" means discretionary; "shall" or "will" means mandatory.
